General Terms of Service and Use

These terms govern the use of the CamperOwl web application and the features connected to it.

1. Provider

CamperOwl is provided by Emrah Arican Digital Services, Emrah Arican, Sterchelestr. 14, 79379 Müllheim, Germany.

2. Scope

These terms apply to the use of the CamperOwl web application, including trip planning, place displays, saved favourites, account functions and other features available in the application.

3. Formation of contract and use

The mere use of publicly accessible content does not yet create a separate individual contract. Where the application offers registration or account-related features, a usage relationship is created when the registration or activation of the respective account is completed successfully.

4. Scope of services

CamperOwl provides digital functions for displaying, structuring and managing trip and place data. The exact scope of services depends on the current state of the application. There is no entitlement to specific features, integrations or an unchanged product design at all times.

5. Availability

We aim to keep the service available with as little interruption as possible. Maintenance, technical incidents, security measures, changes to external interfaces or force-majeure events may nonetheless restrict availability temporarily.

6. User account and credentials

Credentials must be kept confidential and protected against unauthorised access by third parties. Users are responsible for activities that can be assigned to their account if they are responsible for those activities.

7. User obligations

  • The application may only be used in compliance with applicable law.
  • No unlawful, misleading or technically harmful content may be uploaded or stored.
  • Automated or abusive use that impairs the service is prohibited.
  • Third-party rights, especially copyright, trademark and personal rights, must be respected.

8. User content

Where users store or provide content in the application, they confirm that they are entitled to do so. The user grants the provider the rights required for storage, processing, technical reproduction and display within the application, to the extent necessary for operating the service.

9. External content, data sources and links

The application may include external data sources and map, routing, weather or media services. No warranty is assumed for the content, availability or accuracy of external sources. Relevant source and licence notes are shown separately in the application.

10. Charges

Unless expressly stated otherwise in the application, the use of the offered features is free of charge. For future paid services that are specifically identified as such, the prices and additional conditions published at the time of the offer apply.

11. Suspension and termination

The provider may temporarily suspend access or terminate a user relationship for good cause if these terms or applicable law are violated, or if the security or integrity of the service is endangered.

12. Liability

The provider is fully liable for intent and gross negligence and for injury to life, body or health. In the event of slightly negligent breaches of essential contractual duties, liability is limited to the foreseeable damage typical for this type of contract. Otherwise, liability is excluded to the extent permitted by law.

13. Changes to the terms

The provider reserves the right to change these terms where objective reasons require it, for example because of feature changes, legal adjustments or security requirements. The version published at the time of use is decisive.

14. Applicable law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not remove mandatory legal protections of the state in which the consumer has their habitual residence.
